TERMES DE REFERENCE POUR LE RECRUTEMENT D’UN SPÉCIALISTE EN PASSATION DES MARCHES DE L’UNITÉ D’EXÉCUTION DE L’ABER

  1. CONTEXTE ET JUSTIFICATION

Le Gouvernement de la République du Burundi a obtenu un don de la Banque Mondiale pour financer le Projet d’Energie Solaire dans les communautés locales «SOLEIL-NYAKIRIZA» pour un montant global de 100 millions de dollars américains.

Objectif global du Projet d’élargir l’accès aux services énergétiques pour les ménages, les entreprises, les écoles et les établissements de santé dans les zones rurales du Burundi. Le projet proposé place l’énergie comme principal vecteur de développement du capital humain. Les énergies renouvelables hors réseau serviront de catalyseur pour renforcer la prestation de services de santé et d’éducation et développer les activités productives dans les zones rurales.

Le Projet comprend cinq composantes à savoir:

Composante 1: Services énergétiques pour les écoles et les centres de santé (27,0 millions de dollars).

Composante 2: Services énergétiques pour les communautés rurales (37,0 millions de dollars).

Composante 3: Services énergétiques pour les ménages (17,0 millions USD).

Composante 4: Assistance technique, renforcement des capacités et appui à la mise en œuvre du projet (19,0 millions de dollars).

Composante 5: Composante contingente d’intervention d’urgence (CERC) (US $ 00,0 millions).

Le Projet SOLEIL-NYAKIRIZA sera mis en œuvre sur une période de 6 ans par le Ministère de l’Hydraulique, de l’Énergie et des Mines (MINHEM) via l’Unité de Coordination du Projet (UCP) qui pilotera la mise en œuvre du Projet, et l’Agence Burundaise d’Électrification Rurale (ABER) qui aura la délégation pour la mise en œuvre de la composante 2 du Projet.

La composante 2 du Projet, objet des présents Termes de Références, financera le déploiement de plusieurs mini-réseaux utilisant des modèles commerciaux qui tirent parti du secteur privé dans les domaines où l’approvisionnement en électricité par le biais des mini-réseaux représente l ‘ option la moins coûteuse du point de vue national. Les mini-réseaux seront développés (construits, exploités et entretenus) au moyen d’une approche PPP fondée sur le marché dans le cadre de laquelle le secteur privé fournira des services d’électricité sur une base de construction, d’exploitation et d ‘ opération.

Pour accomplir les activités de la composante 2 du Projet telles que prévues dans le document justificatif du Projet, le Gouvernement désire recruter un / une Spécialiste en Passation des Marchés Junior de l’Unité d’Exécution de l’ABER . Ses responsabilités et le profil sont présentés dans les Termes de Référence. Le Consultant devra travailler l’étudiant avec le Spécialiste en Passation des Marchés Senior de l’Unité de Coordination du Projet (UCP), les services techniques de l’ABER, et les autres partenaires utilisés.

  1. OBJECTIFS

 Ces Termes de référence viser à décrire les tâches et le processus de recrutement du Spécialiste en Passation des Marchés Junior de l’Unité d’Exécution du Projet au sein de l’ABER.

III. NATURE ET ÉTENDUE DE LA MISSION

 Sous la supervision du Chef de Projet au sein d’ABER et en coordination étroite avec le Spécialiste en passation de marchés Senior de l’UCP, le Spécialiste en passation des marchés Junior – ABER aura les missions ci-après, parents à la composante 2 du projet:

  • Mettre sur pied le plan de passation des marchés au niveau de l’Unité d’Exécution ABER;
  • Mettre en place les instruments de base de la passation des marchés dans le respect strict des procédures de la Banque mondiale (Manuel des opérations, directives et documents de gestion des marchés conformes aux exigences du Manuel d’exécution du projet);
  • Mettre en place des outils de gestion des marchés adaptés aux besoins du projet dont le plan de passation des marchés et sa mise à jour périodiquement;
  • Superviseur de la formation des partenaires sur les procédures de passation de marchés;
  • Développer des mécanismes de suivi de l’exécution des contrats, des procédures et des pratiques nécessaires à l’intégrité du système de passation des marchés dont le système de classement.

Plus précisément, le Spécialiste en Passation des Marchés – ABER sera:

  • Spécialiste de la mise en place d’un système simple de gestion de la passation des marchés comprenant (i) la planification des opérations de passation des marchés, (ii) le suivi de l’avancement, (iii) l’analyse de l’écart entre les réalisations et le plan de passation des marchés;
  • Spécialiste de la qualité de l’ensemble du processus d’acquisition, et plus précisément de ce qui suit:
  • Faire le suivi auprès des services techniques bénéficiaire de l’acquisition ou de l’unité d’exécution d’ABER pour la préparation et la finalisation des termes de référence (TDR), pour les acquisitions de Services de Consultants, et des spécifications techniques des biens et travaux et services autres que les services de consultants pour la composante 2;
  • Assurer le contrôle qualité de tous les documents de passation des marchés préparés pour la composante 2 exécutée par l’Agence Burundaise d’Électrification Rurale – ABER dont notamment les dossiers d’appel d’offres, et des demandes de propositions (suivant les modèles de l’IDA) préparé par les services techniques et / ou consultants indépendants devant être soumis au CTP pour validation avant la demande de non objection de l’IDA;
  • Procéder au lancement des appels d’offres (le cas échéant aux avis à manifestation d’intérêt ou présélection), selon les modes convenus dans les accords de prêts ou de dons;
  • Veiller à la bonne gestion des appels d’offres et des demandes de propositions en cours;
  • Participer aux séances publiques d’ouverture des plis pour fournir des conseils et assurer le contrôle qualité des rapports d’ouverture des offres et propositions reçues, préparés par les services techniques;
  • Assurer le contrôle qualité des rapports d’ouverture de plis et d’évaluation des offres à signer conjointement par les autres membres désignés de ces commissions;
  • En coordination avec le spécialiste en passation de marchés Senior de l’UCP, être l’interlocuteur de la Banque mondiale pour toutes les questions relatives aux acquisitions notamment pour toutes les communications liées à l’obtention des non objections du bailleur;
  • Assister les services techniques dans la préparation des contrats, après l’évaluation des avis de non-objection si c’est requis, et veiller à leurs signatures par les personnes habilitées à le faire;
  • Concevoir et mettre en place une base de données fournisseurs, et développer des statistiques de gestion qui utilisent aux bailleurs de mesure le niveau de performance de l’équipe chargée de la passation des marchés;
  • Veiller à ce que les décisions de passation des marchés respectent les accords convenus;
  • Contribuer à la résolution de tout problème de passation des marchés qui pourrait survenir;
  • Assurer la planification des activités et le suivi des dossiers de marchés pour éviter tout retard dans le processus de passation, d’attribution, de signature et d’exécution des marchés;
  • Coordonner sa mission avec le Spécialiste en Gestion Financière et Comptable de l’Unité d’Exécution – ABER afin de s’assurer que la passation des marchés s’intègre parfaitement dans la planification et la gestion des fonds;
  • Ancien et coacher les personnels clés de l’Unité d’Exécution d’ABER.
  • Chargé (e) de planifier, préparer et coordonner le calendrier d’acquisition des Services de Consultants et de biens et travaux et Services autres que les Services de Consultants;
  • Fournir au spécialiste en passation de marchés de l’UCP toutes les données nécessaires à la gestion de la passation de marchés au niveau de l’ABER de manière régulière, et tel que défini dans le Manuel d’exécution du Projet;
  • Chargé (e) de réviser tous les rapports d’activités prescrits par le Manuel des procédures d’acquisition de l’Unité d’Exécution de l’ABER, mais également de tout autre rapport que le bailleur ou autres parties pourraient demander dans le cadre de l’exécution du projet;
  • Chargé (e) de la mise en place d’un système de classement des dossiers de passation des marchés qui inclura pour chaque marché tous les documents relatifs à ces marchés et inclus les documents relatifs aux paiements, en vue de permettre toute revue à posteriori de l ‘ IDA ou audit externe de passation des marchés;
  • Chargé (e) d’introduire régulièrement les dossiers de passation de marchés dans le STEP et de leur qualité;
  • Contribuer au processus d’amélioration permanente des solutions pour les aspects passation des marchés et fournir des entrées pour les manuels correspondants;
  • Exécuter toute autre tâche lui confiée par le chef de projet au sein de l’ABER en relation avec les tâches définies dans ses TDR.

Dans sa mission au sein de l’équipe, le Spécialiste de la Passation des Marchés Junior– ABER répartera un conseil utile à tous les membres de l’équipe dans:

  • La phase d’ouverture des plis, d’évaluation des offres et de proposition d’attribution du marché;
  • L’assistance à la réponse aux demandes de clarification des soumissionnaires;
  • La réponse aux commentaires de la Banque et de tout autre bailleur de fonds;
  • Les propositions de solution alternative problématique de passation des marchés ne peuvent être résolu à l’interne;
  • L’examen de toute correspondance arrivée ou départ concernant la passation des marchés afin de s’assurer que le courrier a reçu le traitement adéquat dans le parfait respect des règles.
  • L’interprétation des clauses du contrat en cas de différend pendant l’exécution du contrat
  1. DESCRIPTION DÉTAILLÉE DES TACHES

 Ces tâches seront directement effectuées par le Spécialiste en passation de marché – ABER pour les activités relatives à la composante 2.

  1. Préparer et coordonner la planification pour la passation des marchés (PPM) comprenant les Services de consultants, les travaux, les fournitures et les services autres que les Services de consultants;
  2. Saisir le Plan de Passation des Marchés et toutes les étapes du processus de passation des marchés dans le logiciel approprié de la Banque mondiale.
  3. Mettre à jour le Plan de Passation des Marchés au moins une fois l’an et chaque fois que de besoin;
  4. Concevoir / mettre en œuvre un système (procédures) de classement et d’archivage physique et dans la plateforme STEP de tous les documents et dossiers de marchés;
  5. Ancien des personnels clés à la prise en main du système de classement et d’archivage;
  6. Développer un mécanisme de suivi de la passation des marchés, y compris des délais, afin de pouvoir identifier rapidement les sources potentielles de retard, d’en informer le Coordonnateur et de proposer des solutions pour les résoudre:
  7. Ouvrir et tenir à jour un répertoire des Fournisseurs, des Entreprises et des prestataires de services autres que les services de Consultants au cours de la vie du projet;
  8. Tenir également un répertoire de Consultants qualifiés au fur et à mesure des manifestations d’intérêts;
  9. Ouvrir et tenir à jour un bordereau des prix unitaires les plus usuels.
  10. Établir chaque mois la situation des marchés assortie d’un plan d’action qui dégage les responsabilités de toutes les parties concernées, ainsi que les délais d’exécution;
  11. Procéder à une grande diffusion du plan d’action;
  12. Rédiger (ou faire rédiger par le spécialiste en passation de marchés de l’unité d’exécution d’ABER pour la composante 2) des demandes de manifestation d’intérêt pour le recrutement des consultants;
  13. Préparer (ou faire préparer par le spécialiste en passation de marchés de l’Unité d’exécution d’ABER pour la composante 2) les Dossiers de Présélection, les Dossiers d’Appel d’Offres (DAO), les Demandes de Cotation (DC ) et les Demandes de Propositions (DP)
  14. S’assurer de la qualité des spécifications techniques et des Termes de Référence produits par les experts sectoriels de l’UCP, des agences d’exécution et de tout autre partenaire de la mise en œuvre du Projet;
  15. Assurer (ou faire assurer par le spécialiste en passation de marchés de l’unité d’exécution d’ABER pour la composante 2) la publication des avis spécifiques d’appels d’offres dans la presse nationale et / ou internationale et dans UNDB si cela s’avère nécessaire selon le montant estimé et la complexité du marché; et en assurer le suivi.
  16. Rédiger (ou faire rédiger par le spécialiste en passation de marchés de l’unité d’exécution d’ABER pour la composante 2) les avis généraux, les avis spécifiques et les demandes de manifestations d’intérêts pour recevoir les expressions d’intérêts pour les services de Consultants, les avis de présélection et les avis spécifiques d’appels d’offres de travaux et de fournitures et de services autres que les services de Consultants;
  17. Assurer (ou faire assurer par le spécialiste en passation de marchés de l’unité d’exécution d’ABER pour la composante 2) la publication des avis généraux et des avis spécifiques d’appels d’offres dans la presse nationale et / ou internationale et dans UNDB si cela s’avère nécessaire selon le montant estimé et la complexité du marché;
  18. Assurer le suivi de la publication des avis généraux et des avis spécifiques d’appels d’offres dans les supports adaptés;
  19. Programmer et préparer les sessions des commissions de passation de marchés, y compris l’inscription dans l’ordre du jour des étapes du processus d’évaluation des offres (ouverture des plis, évaluations et attributions);
  20. Assurer l’encadrement ou proposé le secrétariat des commissions d’analyse, avec voix non délibérative et s’assurer que toutes les décisions liées à la passation et à l’exécution des marchés ont respecté les règles convenues;
  21. Assister pour le compte du Projet aux commissions d’ouvertures de plis, aux évaluations des offres, aux attributions de marchés, afin de pouvoir conseiller utilement les acteurs impliqués dans la passation des marchés et en être rapporteur, pour les composants 1,3,4 et 5);
  22. Assurer l’encadrement ou proposé le secrétariat des commissions d’analyse, avec voix non délibérative;
  23. Veiller à la confidentialité des rapports d’évaluation des offres et s’assurer que ceux-ci reçoivent les approbations nécessaires des membres compétents de l’Administration si nécessaire;
  24. Préparer les demandes d’avis de non-objection (ANO) à adresser à la Banque mondiale;
  25. Assurer le suivi des demandes d’avis de non-objection à adresser à la Banque mondiale;
  26. Préparer les marchés et veiller à ce qu’ils soient conformes, visés et notifiés selon le manuel des procédures et dans les meilleurs délais;
  27. Établir (ou, dans le cas de la composante 2, faire en sorte que le spécialiste en passation de marchés de l’unité d’exécution d’ABER établisse) les marchés et veiller à ce qu’ils soient atteints, visés et notifiés selon le manuel des procédures et dans les meilleurs délais;
  28. S’assurer (ou, dans le cas de la composante 2, faire en sorte que le spécialiste en passation de marchés de l’unité d’exécution d’ABER s’assure) que les résultats des appels d’offres sont publiés dans les délais prescrits après les attributions des marchés;
  29. S’assurer que toutes les décisions liées à la passation et à l’exécution des marchés ont respecté les règles convenues;
  30. S’assurer que les soumissionnaires non retenus reçoivent les informations nécessaires ainsi que leurs avertissements de soumission aussitôt après la décision d’attribution des marchés.
  31. Conseiller les experts sectoriels et le Coordonnateur dans la compréhension et la rédaction de tout courrier entrant ou sortant ayant des aspects de passation des marchés;
  32. Organisateur et réaliser des sessions de formation en interne selon une périodicité à convenir avec le Coordonnateur pour autonomiser à terme, l’UCP et les Agences impliquées dans le projet dans l’application correcte quotidienne du Règlement de la Banque en matière de passation des marchés;
  33. Exécuter toute tâche ou mission liée à la passation de marchés demandée par le Coordonnateur;
  34. Dans le cas de la composante 2, assurez-vous que l’unité d’exécution d’ABER fournisse toutes les informations nécessaires au suivi des aspects de passation de marché pour tout le projet;
  35. Faire prendre toutes les dispositions utiles à la bonne supervision de l’exécution des marchés, en tenant compte de leurs spécificités et apporter les conseils appropriés dans l’exécution des marchés et surtout en ce qui concerne la résolution des différends qui pourraient survenir;
  36. L’organisation de la commission de réception des fournitures, des travaux et des prestations;
  37. S’assurer que les biens et services soient livrés et entreposés en sûreté aux endroits et aux dates précisés conformément aux dispositions des marchés;
  38. Préparer les rapports périodiques sur la situation des marchés et contribuer à l’élaboration du rapport de suivi financier (RSF sur les aspects de passation des marchés;
  39. Participer à l’élaboration de la mise à jour des rapports sur l’utilisation et le fonctionnement des équipements mis à la disposition des diverses composantes du projet.
  40. Apporter des conseils adaptés dans l’exécution des marchés et surtout en ce qui concerne la résolution des différends qui pourraient survenir;
  41. Veiller (ou, dans le cas de la composante 2, faire en sorte que le spécialiste en passation de marchés de l’unité d’exécution d’ABER veille) à ce que les engagements sur les marchés soient inclus reflétés dans le système d ‘ information et communiqués au Spécialiste en Gestion Financière et au Comptable;
  42. Exécuter toute tâche ou mission liée à l’exécution de marchés demandés par le Coordonnateur de l’ABER.
  1. INCOMPATIBILITE AVEC CERTAINES FONCTIONS D’EXÉCUTION

Afin de découvrir les situations potentielles de conflit d’intérêt qui pourrait ne pas lui permettre de donner un avis objectif dans le seul intérêt du client (incompatibilités avec certaines fonctions d’exécution) en raison de son rôle de conseiller dans les décisions de passation des marchés et de sa forte implication dans l’élaboration des dossiers de marchés, le (la) Spécialiste Passation de Marchés:

  • Ne sera pas membre des Commissions d’évaluation, ni des commissions d’attribution des marchés et il / elle apporte un conseil utile pour le respect des règles il / elle pourrait cependant appuyer sur le secrétaire de la Commission d’attribution des marchés;
  • Ne devra pas participer aux opérations d’exécution du marché notamment (i) les réceptions de qualité ou de quantité et (ii) le paiement; il / elle apporte un éclairage en cas de contenu dans l’interprétation des clauses du contrat; et
  • Ne devra pas être dans une position de gestionnaire comptable de matières

Le (la) Spécialiste en Passation de Marchés Junior ne doit pas percevoir de jetons de présence aux différentes commissions ou sous-commissions qu’il / elle sera appelé (e) à participer

  1. RESPONSABILITE DANS LE TRANSFERT DE COMPETENCE ET LE RENFORCEMENT DES CAPACITES

Le Spécialiste en Passation de Marchés Junior définira et mettra en application sous la supervision du Chef de Projet au sein de l’ABER, un programme de renforcement des capacités des personnels clés de l’ABER.

VII. PERIODE ET CRITERES DE PERFORMANCE

7.1. Durée du contrat

Le premier contrat sera d’une durée d’une année. Si à l’issue de cette période, l’évaluation des performances est satisfaisante, le contrat suivant sera pour une période de deux années renouvelables.

7.2 Critères de performance

L’efficacité et les performances du Spécialiste en Passation des Marchés seront mesurées en fonction:

  • de la qualité du suivi des actions inscrites dans le Plan de Passation de Marchés;
  • du respect des délais d’exécution du Plan de Passation de Marchés, pour des actions qui relèvent de ses responsabilités;
  • de la qualité des DAO, des demandes de cotation et des demandes de propositions;
  • de la qualité du suivi des procédures de passation et des avis de non objection.

VIII. OBLIGATIONS DE L’UNITÉ D’EXÉCUTION VIS-A-VIS DU SPÉCIALISTE EN PASSATION DE MARCHES.

L’ABER et son Unité d’Exécution Remettront au (à la) Spécialiste en Passation des Marchés Junior l’ensemble des documents, dossiers et outils nécessaires et nécessaires à l’exécution de sa mission. Elles se mettent également à disposition, les locaux et les équipements nécessaires pour assurer une bonne prestation de service. Une évaluation de la performance du Spécialiste en Passation des Marchés sera faite tous les six mois au cours des missions de supervision de la Banque Mondiale.

  1. RÉMUNÉRATION ET ECHEANCES DE PAIEMENT

Les termes de rémunération seront alignés sur l’Ordonnance du Ministre des Finances, du Budget et de la Planification Economique (Ordonnance Ministérielle Nº0540 / 1667 du 24 novembre 2020) portant harmonisation des rémunérations et les frais de fonctionnement des Gestionnaires et personnels des projets financiers par les Partenaires Techniques et Financiers (PTF)

  1. QUALIFICATIONS PROFESSIONNELLES NELLES ET ACADEMIQUES

Le Spécialiste en Passation de Marchés du Projet devra:

  • Avoir un diplôme de licence ou équivalent au moins en Ingénierie, Architecture, Administration, Passation des marchés, Droit, Finances, Commerce, Gestion, Economie, Sciences humaines (BAC minimum + 4)
  • Disposer d’une excellente connaissance de la passation des marchés en général, et des procédures de passation des marchés des Banques multilatérales de développement ou des bailleurs de fonds multilatéraux de développement: Banque Africaine de Développement (BAD) et Banque mondiale (BM) ou des les institutions internationales comme l’Union Européenne, les organisations des Nations Unies, etc.
  • Disposer d’une expérience professionnelle de cinq (5) ans minimum dont trois (3) et au moins à un poste de passation des marchés dans le secteur public ou privé ou avoir assumé des responsabilités similaires dans ce domaine. L’expérience dans un projet de financement d’un Bailleur de fonds extérieur notamment des Banques multilatérales, en particulier de la Banque Mondiale est un atout;
  • Avoir une bonne capacité de résolution des problèmes liés à la passation de marchés;
  • Avoir une maîtrise du français, la connaissance de l’anglais est souhaitée;
  • Avoir une maîtrise de l’outil informatique;
  • Avoir une bonne aptitude pour la communication et le travail en équipe.
  • Les femmes sont encouragées à postuler à ce poste
  1. CONSTITUTION DU DOSSIER
  1. Les candidats doivent fournir un dossier composé de:
  • Une lettre de motivation adressée au Président du CTP;
  • Un curriculum vitae actualisé, confectionné suivant le modèle en annexe 

En cas de nécessité, des copies certifiées conformes à l’original des diplômes, certificats et tout autre document attestant l’expérience professionnelle pourraient être demandés.

XII. CONDITIONS D’EMPLOI

  • Le (la) Spécialiste en Passation des Marchés Junior sera une personne physique rattachée à l’Unité d’Exécution de Projet – ABER ;
  • C’est un poste individuel à temps plein;
  • Le (la) Spécialiste en Passation des Marchés est appelé à s’abstenir de toute situation qui pourrait le mettre en conflits d’intérêts dans le cadre de la mission qui pourrait lui être assignée.

XIII. METHODE ET PROCEDURE DE SELECTION

Le Spécialiste en Passation des Marchés sera sélectionné selon la méthode de Sélection des Consultants Individuels, conformément au Règlement applicable aux Emprunteurs – Passation des Marchés dans le cadre de Financement de Projets d’Investissement, Juillet 2016, Mise à jour Novembre 2017, Août 2018 et Novembre 2020 de la Banque Mondiale («le Règlement de passation des marchés») et conformément aux critères exigés au regard des présents termes de référence.

La sélection du (de la) Spécialiste sera effectuée par appel à candidatures. Le (la) Spécialiste en passation des marchés Junior sera retenu, après avis de non objection de la Banque Mondiale, en fonction de ses qualifications et expériences pertinentes, et sa capacité à réaliser pleinement la mission.

 La procédure de sélection comporte deux (2) phases:

  • Phase de présélection des candidats sur la base de comparaison des CV des candidats sur 100 points;

Cette étape sera constituée d’une présélection sur base de dossiers où seront retenus les candidats ayant les qualifications et l’expérience requises pour le poste conformément aux TdR ci-dessus.

La répartition des notes pour cette phase sera faite dans l’esprit de ne retenir que les candidats ayant le meilleur profil en privilégiant l’expérience pertinente des candi-dats pour le poste qui sera notée à pas moins de 75% par rapport aux autres critères .

A cette phase, seuls les candidats ayant reçu une note minimale de 75% seront retenus.

Au cas où aucun des candidats n’aura totalisé la Note Minimale de 75%, il sera alors retenu les trois premiers parmi ceux ayant reçu une Note Supérieure ou Egale à 70%

  • Phase d’interview des candidats présélectionnés sur 100 points .

Après la non-objection de la Banque mondiale sur les résultats de la présélection, il sera procédé à l’interview des candidats retenus

A la fin du processus, les candidats seront classés par ordre de mérite après pondération des différentes notes obtenues dans les 2 phases de la sélection. La note du CV aura un poids de 70% et celle de l’interview 30% (le CV sera pondéré pour 70% et l’Interview pour 30%)

Les Candidats seront alors classés en fonction de leurs Notes Finales (N f ) obtenues sur CV (N cv ) et à l’Interview (N i ) combinées en utilisant les pondérations comme suit:

Remarque finale N f  = N cv  x 70% + N i  x 30%.

NB Le Comité de recrutement se réserve le droit d’utiliser tous les moyens à sa disposition pour s’assurer que les informations qui lui sont communiquées par les candidats sont exactes.
